1. Acceptance of Terms: By accessing or using this website and service, you (“User” or “you”) agree to these Terms of Use and all other applicable policies. If you do not agree, you must not use this service. We may update these terms from time to time and will notify users by updating the “Effective Date” or via email/website notice. Continued use of the service after updates constitutes acceptance of the new terms.
2. Service Overview and Parties: PFC Club India Pvt. Ltd. (“PFC”) provides an online platform facilitating a GLP-1 weight loss subscription program. This includes connecting users with licensed medical practitioners for telemedicine consultations, fitness/nutrition coaching, and coordinating the delivery of prescription medication. Prescription medications (such as Mounjaro or other GLP-1 analogues) are dispensed and sold by our licensed pharmacy partner in compliance with the Drugs and Cosmetics Act, 1940 and applicable rules. PFC itself does not manufacture or stock medications; it provides the interface for users to obtain consultations and place orders which are fulfilled by the pharmacy. The roles of each party are: PFC handles the website, user registration, prescription validation, and payment processing; the pharmacy handles drug procurement, quality control, packaging, and shipping, and will issue the invoice for the medication portion of the service.
3. Eligibility: You must be at least 18 years old and legally competent to use this service. The service is intended for adult individuals residing in India. It is not intended for use by minors or by individuals who are pregnant or nursing, or those with serious underlying health conditions, unless under explicit medical supervision. By registering, you represent that you are 18 or older, not pregnant, and that you will use the medication only for yourself as prescribed. You also agree to provide valid identification and accurate personal information as needed to verify age and identity.
4. User Responsibilities (Accuracy of Information): You agree that all information you submit to the platform is truthful, accurate, and complete. This includes information in the waitlist or signup form, medical history questionnaires, consultation inputs, and payment details. You will disclose any prior or current medical conditions, allergies, and medications to the consulting doctor truthfully. Providing false, misleading, or incomplete information is prohibited and could result in denial of service, cancellation of subscription without refund, and potential legal liability. You acknowledge that the doctor will rely on the information you provide to make medical decisions; therefore, you consent to provide information that is accurate and up-to-date to the best of your knowledge. If your health status or medications change during the subscription, you must inform the healthcare providers.
5. Medical Consultations and Telemedicine: By using our service, you consent to receive medical consultations remotely via telemedicine (video, phone, and/or chat) from qualified Registered Medical Practitioners (RMPs) licensed in India. You understand that the Telemedicine Practice Guidelines, 2020 issued by the Medical Council of India/NMC apply to these consultations, and that our doctors will follow these guidelines. Each teleconsulting doctor will disclose their name, qualification, and medical registration number to you as required. You and the doctor have the right to discontinue the teleconsultation at any stage if needed. The doctor will decide if a telemedicine consultation is sufficient or if an in-person examination is required, based on your specific situation.
Not for Emergencies: You understand that our telemedicine services are not intended for medical emergencies or acute conditions requiring immediate intervention. In case of a medical emergency (for example, severe chest pain, difficulty breathing, suicidal ideation, etc.), you should call emergency services or visit the nearest hospital and not rely on this online service. PFC Club and its practitioners reserve the right to refuse or terminate a consultation if they believe the situation is an emergency or beyond the scope of what can be safely handled via telemedicine, in which case they will refer you to appropriate emergency care.
6. Prescription and Pharmacy Fulfillment: Our service includes the facilitation of necessary prescription medication for weight loss (e.g. GLP-1 agonist injections like Mounjaro). Prescription Issuance: Medications will only be prescribed if deemed appropriate by the consulting doctor, who will issue a valid prescription in your name. All prescription in compliance with the Telemedicine Practice Guidelines and the Drugs & Cosmetics Act and Rules. We do not provide any prescription drug without a proper prescription from a licensed physician.
Dispensing and Delivery: By enrolling in this subscription, you authorize PFC and the consulting doctors to send your prescription to our partner pharmacy (Shree Jalaram Pharma) for fulfillment. You understand that you have the right to receive the prescription and purchase medicines from a pharmacy of your choice; should you prefer to use a different pharmacy, you must inform us, and note that the subscription’s medication delivery service may not apply in that case. The pharmacy partner will dispense the medication against the prescription and arrange delivery to your provided address.
Quality and Legitimacy of Drugs: The pharmacy partner is a licensed distributor under Indian law, and is responsible for the quality, packaging, and timely dispatch of the medication. The medication provided (such as Mounjaro) has obtained the necessary approvals/marketing authorization from the Central Drugs Standard Control Organization (CDSCO) for use in India. We ensure that all medications are sourced from legitimate manufacturers and comply with applicable quality standards.
Receipt and Use of Medication: Upon delivery, you should check the packaging and labels. Use the medication strictly as directed by the prescribing doctor. Do not share the medication with anyone else. If you have any adverse reaction or issues with the medication, stop using it and promptly contact the doctor or emergency services as appropriate.
7. Payments and Subscription Terms: By purchasing our weight loss subscription, you agree to pay the fees indicated for the plan. The subscription fee typically covers the initial doctor consultation, follow-up virtual consultations as scheduled, the medication (drug) cost for the subscription period, and access to coaching services as described. Payments are processed securely via our payment gateway. All fees are listed in Indian Rupees and are inclusive of applicable taxes unless stated otherwise.
Recurring Billing: If your plan involves recurring monthly payments, you authorize us to auto-debit the recurring fees from your provided payment method, in compliance with RBI e-mandate guidelines. You may cancel the subscription at any time; however, note that refunds for any unused portion of services or medication already dispatched will be subject to our refund policy (see below). If you cancel before the next shipment, we will not charge further, but charges already incurred for delivered services are non-refundable (except as required under applicable consumer law). We will comply with the Consumer Protection Act, 2019 regarding any refund or cancellation obligations to consumers.
Refund Policy: Due to the nature of medical services and prescription products, we generally do not offer refunds for services already rendered (e.g. completed doctor consultations) or for medicines that have been delivered or opened. If you experience a service failure or a product defect (such as a damaged parcel or medication recall), please contact us and the issue will be reviewed in line with consumer protection laws. Any approved refunds will be processed within 15 days to the original payment method.
8. Privacy and Data Protection: Your privacy is extremely important to us. Our collection, use, storage, and sharing of your personal information (including health information) are governed by our Privacy Policy (see below) and by Indian data protection laws like the Information Technology Act, 2000 and its applicable data protection rules. By using this service, you consent to the collection and use of your information as described in the Privacy Policy. We implement reasonable security practices to protect your data as required under law. Health and medical information you provide is classified as “Sensitive Personal Data or Information” under Indian law, and we handle it with a high degree of care and confidentiality. We will not share your personal health information with third parties except as needed to provide the service (e.g. sharing relevant details with the consulting doctor, or your name and address with the pharmacy for delivery) or as required by law. 9. Health and Medical Disclaimers: While our service involves licensed physicians and offers medical guidance, PFC Club itself is not a healthcare provider and does not practice medicine. All medical advice, diagnoses, and treatment plans are given by the independent RMPs (doctors) who are part of the service. PFC Club does not guarantee any particular outcome from the program – individual weight loss results will vary. No Guarantee of Results: Weight loss and health outcomes depend on many factors (including adherence to diet/exercise, individual metabolism, underlying conditions, etc.), and thus no specific amount of weight loss or other health improvement is promised. Testimonials or case studies (if any on our site) are illustrative only and do not assur will achieve the same results.
Not a Substitute for Regular Medical Care: The service is not intended to replace your relationship with your primary healthcare provider. You should continue to have regular medical check-ups and seek in-person medical care for any conditions that require it. Always consult your doctor before making significant changes to your diet or exercise routine; if you have any contraindicated conditions (e.g. pregnancy, severe organ issues), use this service only under approval of your physician. If you are under treatment for any illness or on other prescription medication, it is your responsibility to inform our doctors and to discuss with your personal physician before combining our program with your existing treatment plan.
10. Fitness and Nutrition Coaching Disclaimer: As part of the subscription, you may receive guidance from a dietitian or coach regarding exercise and nutrition. You acknowledge that these coaching services are for general wellness and educational purposes and do not constitute medical advice. The trainers/coaches are not medical doctors, and their advice should not be relied upon as a substitute for medical consultation for any health condition. Any diet plans or fitness routines provided should be followed sensibly, taking into account your own abilities and any medical limitations.
Risks of Exercise/Nutrition Changes: There is an inherent risk in any fitness activity; consult with your physician before beginning any new exercise regimen, especially if you have known health issues. PFC Club and the coaches will not be liable for any injury, illness, or adverse effects you may experience when implementing workout or diet suggestions, except to the extent caused by our gross negligence. You agree that you assume responsibility for your participation in suggested activities. (See the “Trainer/Coach Services Disclaimer” below for more details.)
11. Intellectual Property: All content on the website and provided through the service, including text, graphics, logos, software, and other materials, is the property of PFC Club or its content suppliers and is protected by intellectual property laws. You are granted a limited, revocable license to access and use the website and content for your personal, non-commercial use of the service. You must not reproduce, distribute, modify, or create derivative works from our content without explicit permission. The trademarks, service marks, and logos displayed (including company names and product names like “Mounjaro”) are the property of their respective owners, and using this service does not grant you any right or license to use them.
12. Prohibited Uses: You agree not to misuse the site or service. Prohibited activities include: (a) attempting to obtain medications without a valid prescription or for any purpose other than your personal use as directed; (b) reselling or distributing any medication obtained through the service to third parties; (c) impersonating another person or using another individual’s account; (d) any activity that violates applicable laws or regulations (including but not limited to the Information Technology Act, Drugs & Cosmetics Act, etc.); (e) uploading or transmitting any harmful code or engaging in any attack on our site’s integrity; (f) harassing or abusing any doctor, staff, or coach on the platform. We reserve the right to terminate or suspend your access if you engage in prohibited conduct.
13. Limitation of Liability: To the fullest extent permitted by law, PFC Club, Shree Jalaram Pharma, and all of our directors, officers, employees, doctors, coaches, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or relating to your use of the service, the inability to use the service, any information obtained from the service, or any products provided (including medication side effects or health outcomes), except where such liability cannot be lawfully excluded. This includes, without limitation, damages for lost profits, lost data, personal injury, pain and suffering, or emotional distress, even if we have been advised of the possibility of such damages. In no event shall our total liability to you for all claims exceed the amount actually paid by you for the subscription in the past six months.
Pharmacy and Medical Liability: PFC Club is a facilitator of healthcare services and does not assume liability for the professional decisions of the doctors (who are independently responsible under their medical licenses) or for the pharmacy’s fulfillment of medication. Any issues arising from the medication (such as manufacturing defects or adverse reactions) will be addressed in cooperation with the pharmacy and the drug manufacturer as required. That said, nothing in these Terms is intended to limit any rights you may have as a consumer under the Consumer Protection Act, 2019 or other applicable laws, and we do not seek to exclude liability for gross negligence, willful misconduct, or other liability that cannot be excluded under law.
14. Indemnification: You agree to indemnify, defend and hold harmless PFC Club, its pharmacy partner, and all of our affiliates, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, or expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the service, your violation of these Terms of Use, your violation of any law or regulation, or your violation of any rights of a third party. This means that if a third party (including, for example, another user or a regulatory autho a claim against us due to your conduct, information, or usage of our service, you will reimburse us for our costs and damages to the extent that claim arises from your fault.
15. Governing Law and Dispute Resolution: These Terms and any dispute arising from the service will be governed by and construed in accordance with the laws of India. Any disputes, differences or claims arising out of your use of the service or relating to these Terms (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra, India. However, we will first attempt to resolve any dispute amicably through negotiation or mediation if you contact us with a concern. Consumers may also seek recourse under India’s consumer dispute resolution forums, if applicable.
16. Compliance with Laws: We operate in compliance with all applicable Indian laws and regulations, including but not limited to the Information Technology Act, 2000, the Drugs and Cosmetics Act, 1940 and Rules thereunder, the Telemedicine Practice Guidelines, 2020, the Consumer Protection Act, 2019, and guidelines issued by authorities such as the Central Drugs Standard Control Organization (CDSCO), the National Medical Commission (formerly MCI), and the Food Safety and Standards Authority of India (FSSAI) as relevant to our services. These Terms of Use shall be interpreted in a manner consistent with those laws. If any provision of these Terms is found to be in violation of a mandatory legal requirement or is held to be invalid by a court, that provision will be modified or severed to the minimum extent necessary so that the remainder of the Terms will continue in full force.
